Why was Tutuska Kicked Out?

The other band members Johny Rzeznik and Robby Takac, say that the falling out of Tutuska, who was their drummer, was on both personal and musical matters.

There had been disagreements in the group for a while, and it only got worse during the last year, which was around 1995. These disputes are what allegedly caused the firing of Tutuska.

Rzeznik said that the disparities in the group had caused a lot of pain and heartaches. But, unfortunately, the differences could not be settled despite them having some good times too.

Robby Takac added that the group did have problems that they were struggling with, especially when they got to recording in the studio. However, he said that it was probably due to the trio working together for years.

The split occurred when the band was scheduled to release a national album and a single for Warner Bros Records’ recording company. The split did shock the Buffalo community probably because the band hand-grown together tremendously from 1985.

However, the band’s remaining members did make it clear that they were not out to get Tutuska, and as painful as the decision was, it was the best decision for the band, and they wished him well. Takac added that they would not give up on the record, and if it became a hit, they would split up the money with Tutuska.

They also stated that they would continue with the group because of their passion for music, which meant getting a new drummer.

Who Was The New Drummer?

In 1995 the band hired a new contract drummer called Michael Malinin, who got promoted to a full-time drummer in 1996. He worked with Goo Goo Dolls for the next 19 years.

Unfortunately, in December 2014, Malinin got fired from the band.

Malinin later went to federal court and sued the founding members Robby Takac and Johny Rzeznik for wrongfully firing him when he was on his tour break for the birth of his twins.

He clearly stated that he was wrongfully kicked out of the partnership. Malinin further said that the timing of his firing was timed to hurt his family and himself financially. He fought for justice on the damages that he stated he had gone through from his former band members’ hatred and despicable conduct.

Malinin felt it was malicious for the other band members to fire him because, in 2013, they planned a band tour to support a new release, and his wife was also due on December 30th, 2013. His fellow band members were aware of the delivery date, and they had agreed to hire a temporary drummer who would cover for Malinin until New Year’sYear’s Eve.

Malinin stated on December 27th, he got a call from the band manager, who informed him that he had been fired for no reason whatsoever. Eventually, the bandstand’s attorney did give him an explanation, which was sent via email. The email explained that he had been fired upon notice without reason.

Malinin stated that when he joined the band as a full-time member, the band grew and made more hits and was even nominated for the Grammys.

He further claimed that as the band grew, he got paid a third of the band’s revenues, which included tour and merchandise profits, advances, and royalties on recordings that he played. He was also expected to pay tour and recording costs. He had paid the touring cost during which he was fired. He, however, claims that the band stopped paying him any income or royalties despite him supporting the 2013 tour financially.

Unfortunately for Malinin, the court denied his motion due to insufficient evidence to show that he was in a partnership with the other Goo Goo Dolls members. The court, however, emphasized that it did not decide that Malinin could never prove that he was never a partner, only that the record at the time was not enough to support a decision that favored Malinin.
